Please read these Terms and Conditions carefully before placing an order on our website. By placing an order with us, you agree to be bound by these Terms and Conditions.

1.1 This website, www.pureearthcollection.com, is owned and operated by Pure Earth Collection Ltd, a company registered in England and Wales (Company No. 10909321).
1.2 Our registered office is: Unit 6, 2-20 Scrutton Street, London, EC2A 4TJ.

2. Agreement to Terms
2.1 Throughout these Terms and Conditions, “we”, “us” and “our” refer to Pure Earth Collection Ltd.
2.2 By accessing our website and/or placing an order, you agree to all terms and conditions set out below.
2.3 We reserve the right to refuse service to anyone for any reason at any time.
3. Orders and Contract Formation
3.1 When you place an order through our website, this constitutes an offer by you to purchase the products.
3.2 We will send you an order confirmation email acknowledging receipt of your order. Please note that this does not mean your order has been accepted. A legally binding contract between you and us is only formed when we dispatch your order.
3.3 We reserve the right to refuse or cancel any order prior to dispatch, including (but not limited to) orders where a pricing error has occurred on the website. If we cancel an order after payment has been taken, we will issue a full refund promptly.
4. Pricing and Payment
4.1 All prices on our website are in GBP and include VAT where applicable.
4.2 We accept payment via Stripe, PayPal, Klarna, Google Pay and Apple Pay.
4.3 While we make every effort to ensure pricing is accurate, errors may occasionally occur. If we discover a pricing error affecting your order, we will contact you before dispatch to give you the option of proceeding at the correct price or cancelling for a full refund.
5. Manufacture
5.1 Our products are designed by our founder and production team. Most of our products are made in a family-run factory in India which is Sedex approved (meaning they have top quality processes, supply chains and worker welfare) and specialises in organic and natural fabrics.
6. Shipping and Delivery
6.1 We offer free standard shipping on all UK orders. Our standard shipping for the UK is Royal Mail 2nd Class. Faster delivery options, including a next day service, are available at checkout. Next day deliveries must be placed before 2pm for a guaranteed next day service.
6.2 Postage to EU countries is subject to additional delivery charges at checkout and usually takes between 3 to 5 business days.
6.3 Orders to the rest of the world are subject to additional delivery charges at checkout and may take up to 10 working days.
6.4 It is the responsibility of the customer to pay any import duty and tax charges if incurred. Pure Earth Collection is not able to take responsibility for taxes or customs duties and orders cannot be recalled to the UK once shipments have been dispatched from the warehouse. Unclaimed items which are returned to us from customs are not able to be refunded.
6.5 If you are not at home when the delivery of your item is attempted, it may be left in a safe place, put through your letter box, taken to a local sorting office or (if DPD delivery) attempted the following day. It is the responsibility of the customer to arrange a redelivery or collect any items from your local sorting office within the allocated time. Unclaimed items which are returned to us from the delivery company may be subject to additional storage or postage charges.
6.6 We will not be held responsible for any delays outside our control which relate to the delivery of parcels.
6.7 It is your responsibility to report all undelivered or lost purchases within 7 days at hello@pureearthcollection.com. In case of an undelivered or lost purchase, it is the customer’s responsibility to comply with Royal Mail’s (or the carrier in question’s) claim compensation process.
6.8 It is your responsibility to provide us with the correct shipping address for your order. If you need to change this after your order is placed, you must update your address details before the item has been shipped. We cannot guarantee that changes to the delivery address can be made as orders are sometimes dispatched within the hour.
7. Your Right to Cancel (Statutory Rights)
7.1 Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, you have a statutory right to cancel your order within 14 days of receiving your goods, without giving any reason. This right applies to all items purchased online, including sale and discounted items.
7.2 To exercise your right to cancel, you must inform us of your decision by a clear statement (for example, by email to hello@pureearthcollection.com).
7.3 If you cancel after the goods have been delivered, you must return them to us without undue delay and no later than 14 days from the day on which you communicate your cancellation. Items must be in their original condition, unused and in their original packaging.
7.4 We will reimburse all payments received from you, including the cost of standard delivery, no later than 14 days after we receive the returned goods or evidence that they have been sent back.
7.5 We may make a deduction from the reimbursement for loss in value of any goods supplied, if the loss is the result of unnecessary handling by you.
8. Our Returns Policy
8.1 In addition to your statutory rights, we offer a generous 60-day no-quibble free returns policy within the UK. You have 60 days from receipt of your products to apply for a refund.
8.2 To return your order, please visit our returns page.
8.3 Items must be in perfect condition at the point of return, unused and in their original packaging with labels. Items returned without packaging or in a used or damaged condition cannot be refunded under our extended returns policy (though your statutory rights under Sections 7 and 9 are unaffected).
8.4 Once orders have been dispatched from our warehouse, we are not able to process refunds or exchanges until the products are received back and checked. In the unlikely event that products are lost or delayed in the post, we will follow this up with the postal service used. We are not able to process refunds on these items until the products are received back or officially declared as lost.
8.5 All refunds must be processed via the customer’s original payment method. In order to prevent fraud, we are not able to process refunds to alternative bank accounts or cards which were not used for the purchase.
8.6 International orders unfortunately cannot be returned under our extended returns policy (though your statutory rights are unaffected if you are a UK-based consumer).
8.7 We strongly advise you to use a secure postal method for all returns, as we cannot refund or exchange items not received.
8.8 We offer a 30-day sleep trial on all our sleeping bags. If you decide after 30 days of using the sleeping bag that it is not for you, we will send you a freepost label to return your sleeping bag and give you a full refund. All sleep trial sleeping bags must be returned in their original packaging with labels. Please note our 30-day sleep trial is valid on one bag per customer only. Any additional bags being returned must be unused and in the original packaging. All used bags must be washed before being returned so we are able to pass them onto charity.
9. Faulty Goods
9.1 Under the Consumer Rights Act 2015, goods must be of satisfactory quality, fit for purpose and as described. If your goods are faulty, not as described, or not fit for purpose, you are entitled to a repair, replacement or refund depending on the circumstances and the time elapsed since purchase.
9.2 If you receive a faulty product, please contact us at hello@pureearthcollection.com with details of the fault. In the unlikely event of a faulty product we will send a replacement product once the goods are returned to us.
9.3 You will not be required to pay return postage costs for faulty goods.
10. Sales and Discount Codes
10.1 Discount codes cannot be used alongside any sale items or other discount codes at any time on our website.
10.2 Pure Earth Collection reserves the right to refund any orders which redeem a discount code on already discounted sale items.
11. Intellectual Property
11.1 All intellectual property rights in this website (including text, graphics, photographs and other images, videos, sound and logos) are owned by Pure Earth Collection Ltd and are for Pure Earth Collection use only.
11.2 If you create a link to this website and we wish to have it removed, we reserve the right to ask you to do so.
12. Your Account
12.1 To register on our website you must be at least 18 years of age. If you are under 18, please ask a parent or guardian to place the order on your behalf.
12.2 You are solely responsible for the confidentiality of your account and password. We will not be held liable for any loss or damage that may result from your failure to keep your account details secure.
13. Website Accuracy
13.1 We reserve the right to modify or discontinue the website at any time without notice.
13.2 We have made every effort to display as accurately as possible the colours and images of our products. We cannot guarantee that your device’s display of any colour will be accurate.
13.3 All descriptions of products or product pricing are subject to change at any time without notice.
14. Limitation of Liability
14.1 Nothing in these Terms and Conditions excludes or limits our liability for death or personal injury caused by our negligence, fraud, or any other liability which cannot be excluded or limited by English law.
14.2 Subject to Section 14.1, our total liability to you in connection with any order shall not exceed the total price paid by you for that order.
14.3 We are not liable for any indirect or consequential losses, including but not limited to loss of profit, loss of business, or loss of data.
15. Complaints and Dispute Resolution
15.1 If you have a complaint about any of our products or services, please contact us at hello@pureearthcollection.com and we will do our best to resolve the issue.
15.2 If we are unable to resolve your complaint, you may wish to consider using an alternative dispute resolution (ADR) service. You can also use the EU/UK Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr.
16. Privacy
16.1 Your use of our website is also governed by our Privacy Policy. Please review it to understand how we collect, use and protect your personal data.
17. Governing Law
17.1 These Terms and Conditions are governed by and construed in accordance with the laws of England and Wales.
17.2 Any disputes arising from or in connection with these Terms and Conditions shall be subject to the non-exclusive jurisdiction of the courts of England and Wales.
18. Changes to These Terms
18.1 We reserve the right to update or amend these Terms and Conditions at any time. The date of the most recent revision will be shown at the top of this page.
18.2 If you have placed an order prior to any change in our Terms and Conditions, the Terms and Conditions in force at the time of your order will apply to that transaction.
